TickTalk App Terms of Use

These TickTalk App Terms of Use (“Terms”) govern your access to and use of the TickTalk mobile application, compatible TickTalk smartwatches, TickTalk accounts, parental-control tools, communication features, location services, cloud services, and related software and services provided by TickTalk Tech LLC (“TickTalk,” “we,” “us,” or “our”).
By selecting “Accept,” creating a TickTalk account, pairing or activating a TickTalk smartwatch, or using the TickTalk App or related services, you acknowledge that you have read, understood, and agree to these Terms and have reviewed the TickTalk Privacy Policy.
If you create or manage an account for a child, you represent that you are the child’s parent, legal guardian, or another adult legally authorized to act on behalf of the parent or legal guardian.
If you do not agree, select “Decline” and do not create an account, pair a device, or use the Services.
1. Parent-Managed Service
TickTalk smartwatches and the TickTalk App are designed to help parents and legal guardians communicate with, locate, and manage connected features for their children.
The parent or legal guardian is responsible for:
- Creating and securing the primary TickTalk account;
- Providing accurate account and child-profile information;
- Providing any required parental consent;
- Pairing and managing the child’s device;
- Approving contacts and authorized App Users;
- Managing communication, location, safety, and device settings;
- Supervising the child’s use of the Services; and
- Using the Services lawfully and appropriately.
Children may use available smartwatch features under the management and supervision of a parent or legal guardian but may not independently create or manage the primary TickTalk account.
2. Children’s Privacy and Parental Consent
TickTalk is committed to protecting the privacy of children and their families.
Where required by the Children’s Online Privacy Protection Act (“COPPA”) or other applicable law, TickTalk will provide parents with notice and obtain verifiable parental consent before collecting, using, or disclosing a child’s personal information.
Depending on the information entered by the parent and the features used, TickTalk may process information associated with a child, including:
- Name or nickname;
- Profile photo;
- Age, birthday, or gender, if provided;
- TickTalk telephone number;
- Device identifiers;
- Parent-approved contacts;
- Precise or approximate device location;
- Location history;
- Daily steps and basic activity information;
- Device status and settings;
- Communication information;
- Photos, videos, voice messages, messages, or other content needed to provide selected features; and
- Technical, diagnostic, security, and usage information.
TickTalk collects and uses this information only as reasonably necessary to provide, operate, secure, support, and improve the Services, or as otherwise described in the TickTalk Privacy Policy.
TickTalk does not sell children’s personal information or use it for third-party targeted advertising or cross-context behavioral advertising.
Parents may request to review, correct, or delete eligible personal information associated with their child and may withdraw consent to further collection, subject to applicable legal, security, and record-retention requirements. Withdrawing consent may prevent continued use of some or all Services.
3. Account Security and Authorized Users
You are responsible for keeping your login credentials and verification codes confidential and for preventing unauthorized access to your account.
The primary account administrator may invite trusted individuals to access certain device features. Depending on the permissions granted, an authorized App User may be able to communicate with the child, view device information or location, receive alerts, or manage certain settings.
You are responsible for:
- Inviting only trusted and authorized individuals;
- Assigning appropriate permissions;
- Reviewing access regularly; and
- Removing access when it is no longer appropriate.
Notify TickTalk promptly if you suspect unauthorized access, fraud, or misuse of the account or device.
4. Communication Features
The TickTalk App and compatible devices may support voice calls, video calls, individual or group messaging, voice messages, photos, videos, voice-to-text, emojis, GIFs, stickers, and related communication features.
Availability depends on the device model, software version, account permissions, wireless or Wi-Fi connectivity, geographic location, and service status.
Parents are responsible for approving contacts and supervising the child’s use of communication features.
TickTalk does not routinely listen to or review private communications. TickTalk and its authorized service providers may process, transmit, store, or access limited communication content or related information when reasonably necessary to:
- Provide a requested feature;
- Deliver or synchronize communications;
- Provide cloud backup or restoration;
- Respond to customer support;
- Protect users and service security;
- Investigate suspected abuse or unlawful activity; or
- Comply with applicable law.
5. Location and Safety Features
TickTalk location features are designed to help parents and authorized users locate a compatible TickTalk device.
Location may be determined or estimated through GPS, cellular networks, Wi-Fi positioning, IP address, or other available technologies.
Location information may be delayed, unavailable, incomplete, or inaccurate because of network coverage, indoor use, device power, GPS visibility, Wi-Fi availability, software conditions, or other circumstances outside TickTalk’s control.
Compatible devices may also support SOS alerts, emergency contacts, 911 calling, Remote Answer, and other safety-related features.
TickTalk is not an emergency-response provider and does not guarantee that:
- A location result will be exact or current;
- An SOS notification will always be delivered;
- A 911 call will always connect;
- An emergency contact will answer;
- Remote Answer will always function; or
- The device will remain connected during an emergency.
These features are supplemental tools and are not a substitute for direct adult supervision or other emergency arrangements.
You must not use location, Remote Answer, communication, or safety features for unlawful surveillance, harassment, stalking, or any other unlawful or harmful purpose. You are responsible for obtaining any consent required by law.
6. Activity Information
Compatible TickTalk devices may collect daily steps or other basic activity information.
Activity information is intended only for general wellness and recreational purposes. TickTalk devices and Services are not medical devices and are not intended to diagnose, treat, monitor, or prevent any medical condition.
Activity results may be incomplete or inaccurate.
7. User Content and T-Cloud
Users may create, transmit, store, synchronize, or back up photos, videos, messages, voice recordings, contacts, settings, and other content through TickTalk Services.
You retain ownership of eligible user-created content. You grant TickTalk and its authorized service providers a limited right to process, transmit, host, store, reproduce, and display that content only as reasonably necessary to provide the requested Services, support users, protect security, or comply with law.
T-Cloud may provide backup, synchronization, and restoration features for eligible content and settings.
TickTalk uses reasonable safeguards to protect stored information, but no wireless, internet, cloud, or storage system can be guaranteed to be completely secure or continuously available. TickTalk does not guarantee that all content will always be successfully backed up, retained, or restored.
8. Acceptable Use
You agree to use the Services only for lawful, personal, family, and intended purposes.
You may not use the Services to:
- Harass, threaten, stalk, exploit, or harm another person;
- Conduct unlawful surveillance or recording;
- Send spam or unlawful communications;
- Upload illegal, abusive, exploitative, or infringing content;
- Access another account or device without authorization;
- Bypass parental controls or security measures;
- Interfere with a device, network, account, or service;
- Modify or conceal device or account identifiers;
- Reverse engineer, copy, or commercially resell TickTalk software or Services; or
- Use any location, safety, or communication feature for malicious, inappropriate, or harmful purposes.
TickTalk may restrict or terminate access where necessary to protect children, users, systems, or service providers or to respond to fraud, abuse, security threats, or unlawful activity.
9. Software, Updates, and Service Availability
TickTalk may provide App, firmware, software, security, configuration, or feature updates. Some updates may install automatically or may be required for continued use.
TickTalk may add, modify, restrict, replace, suspend, or discontinue features because of security, privacy, technical, legal, licensing, carrier, compatibility, or operational requirements.
TickTalk does not guarantee that the Services will always be available, uninterrupted, error-free, compatible with every device or network, or unchanged for the lifetime of a device.
10. Separate Services and Subscriptions
Some TickTalk features require separate products or subscriptions.
Wireless plans, eSIM service, telephone numbers, and cellular connectivity are subject to the TickTalk Wireless Terms of Use and Privacy Policy.
TickTalk Radio is subject to the TickTalk Radio Terms of Use and Privacy Policy.
TickTalk Care+ is subject to the TickTalk Care+ Terms of Use and Privacy Policy.
Deleting the TickTalk App, resetting or returning a watch, unbinding a device, or deleting a TickTalk account does not necessarily cancel a separate subscription. Each subscription must be canceled separately unless TickTalk expressly states otherwise.
11. Account Deletion and Device Reset
A parent or primary account administrator may request account deletion through the available App settings or by contacting TickTalk Support.
When an eligible deletion request is completed, TickTalk will delete or de-identify eligible personal information, subject to applicable legal, security, fraud-prevention, transaction, backup, dispute-resolution, and record-retention requirements.
Deleting an account may permanently remove child profiles, contacts, messages, photos, videos, location history, device settings, cloud data, and authorized-user permissions. Deleted information may not be recoverable.
Before returning, transferring, selling, recycling, or giving away a TickTalk device, you should unbind it from the TickTalk App and perform a factory reset.
12. Privacy
The TickTalk Privacy Policy explains how TickTalk collects, uses, discloses, retains, and protects personal information associated with the TickTalk App, compatible devices, child profiles, communications, location services, T-Cloud, and related Services.
By accepting these Terms, you acknowledge that you have reviewed the TickTalk Privacy Policy.
Where required by law, TickTalk will obtain separate or renewed parental consent for particular information practices or material changes.
13. Disclaimer and Limitation of Liability
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
TickTalk does not guarantee that:
- Communications will always be sent or received;
- Location information will always be available or accurate;
- Emergency or safety features will always operate;
- Content or cloud backups will never be lost;
- The Services will be uninterrupted or error-free; or
- All security incidents can be prevented.
To the fullest extent permitted by applicable law, TickTalk will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the Services.
Nothing in these Terms limits any warranty, consumer right, privacy right, or remedy that cannot lawfully be limited or excluded.
14. Changes to These Terms
TickTalk may update these Terms from time to time.
If a change materially affects user rights or the collection, use, or disclosure of children’s personal information, TickTalk will provide any notice and obtain any renewed parental consent required by applicable law.
If you do not agree to updated Terms, you may stop using the Services and request account deletion.
15. Governing Law
These Terms are governed by the laws of the State of California, except where applicable consumer-protection law requires otherwise.
If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.

Acceptance
By selecting “Accept,” you confirm that:
- You have read and agree to these TickTalk App Terms of Use;
- You acknowledge that you have reviewed the TickTalk Privacy Policy;
- You are the child’s parent, legal guardian, or an adult legally authorized to act on their behalf; and
- You provide any parental consent required for the collection, use, and disclosure of the child’s personal information as described in the applicable parental notice and Privacy Policy.
