1-Year Limited Manufacturer Warranty

TickTalk smartwatches purchased from authorized third-party retailers (www.myticktalk.com), including Amazon and/or Walmart, are eligible for our 1-Year Limited Warranty. Our 1-Year Limited Warranty covers basic hardware defects in workmanship 1-year from purchase. Our Limited Warranty does not apply to normal wear and tear, third party repairs, or any damage caused by misuse, water exposure, heat exposure, or physical damage like broken screens. For international customers, you are responsible for any shipping fees, duties, and/or taxes associated with warranty claim.

TickTalk 5 Monthly Extended Warranty (Up To 24 Months)

For parents seeking peace of mind while their kids enjoy being kids, accidents are an inevitable part of life. Introducing an extended warranty plan as part of TickTalk Wireless monthly plans, we aim to alleviate worries about unforeseen mishaps. Our extended warranty will safeguard against accidental damages from handling (ADH).

Families now have the option to seamlessly include the monthly extended warranty payment directly into their cellular plan, at a nominal cost. TickTalk Wireless offers two plans, both inclusive of the extended warranty:

Essential Plus Plan: $14.99

Premium Plus Plan: $19.99

  • Unlimited Data
  • Nationwide 4G coverage
  • Unlimited Talk

ADH coverage encompasses unintentional actions or mishandling by the user, such as drops, spills, or incidents during regular usage. It does not cover lost or stolen watches.

If you choose to stop your extended warranty coverage you can simply downgrade in your TickTalk Wireless Portal at any time. Please note, the extended warranty remains active for up to 24 months. Beyond this period, your account will automatically transition to either the Essential Plan or Premium Plan, depending on your current subscription.

New TickTalk Wireless Users

This newly introduced extended warranty is exclusively available to new TickTalk 5 users configuring their TickTalk Wireless cellular plans for the first time. If you initially choose a plan without an extended warranty and later opt to upgrade, you must switch within 30 days of purchasing TickTalk 5. Switching after 30 days will result in an automatic downgrade to the same level plan without an extended warranty.

After the first billing cycle, you may downgrade your plan to one without an extended warranty at any time. Once downgraded, you cannot upgrade to a plan that includes an extended warranty again. This plan is not applicable for TickTalk 4 device users. If you have selected the wrong plan, please contact our support team for assistance in switching to the correct plan.

Existing TickTalk Wireless Users

We will still allow all existing TickTalk users that have purchased the TickTalk 5 to change their plan to include the extended warranty within the TickTalk Wireless Portal. You will have 30 days from the TickTalk 5 purchase date to make the switch to a plan inclusive of the extended warranty. Switching after 30 days will result in an automatic downgrade to the same level plan without an extended warranty. 

After the first billing cycle, you may downgrade your plan to one without an extended warranty at any time. Once downgraded, you cannot upgrade to a plan that includes an extended warranty again. TickTalk 4 One Year Extended Warranty 

By adding our 1-year Extended Warranty to your TickTalk purchase, you’ll get complete coverage on your TickTalk 4 to protect from any water damage, broken screens and bands. With Extended coverage, you'll get up to two (2) incidents of accidental damage protection during a 1-year period. 
Extended Warranty only available for US customers. All Extended Warranty purchases must be added within thirty (30) days of original TickTalk smartwatch purchase from an authorized retailer (www.myticktalk.com) and cannot be applied to third party purchases. If you purchased from Amazon, you can add an Extended Warranty from Amazon directly. If you purchased the Extended Warranty in a separate order from your original order, please email support@myticktalk.com with both order numbers so to activate your warranty. If you purchased separately after the 30 day period, please email support@myticktalk.com to process a refund. 


Lifetime Limited Warranty for TickTalk 4 Model Purchases After June 1, 2022

Every TickTalk 4 kids smartwatch purchased from an authorized retailer (www.myticktalk.com)  on or after June 1, 2022, is backed by our Lifetime Limited Warranty. This warranty covers fundamental hardware defects in craftsmanship exclusively for the original purchaser, ensuring the integrity of your TickTalk 4 smartwatch throughout its lifetime, subject to the exclusions outlined below. Should a product under this warranty experience hardware or manufacturing defects, inclusive of broken bands, we pledge to either repair it without cost or replace it based on our judgment.
However, our Lifetime Limited Warranty will not cater to regular wear and tear, acquisitions or mends made through third-party entities, or damages that result from misuse, exposure to water or heat, improper handling, negligence, tangible damages like shattered glass screens, or the natural degradation of materials over prolonged periods. Any damage falling outside the purview of our Lifetime Limited Warranty or Extended Warranty can still be rectified or substituted at a reasonable fee. For international customers, you are responsible for any shipping fees, duties, and/or taxes associated with warranty claim.

Warrantor 

U.S. Purchases ONLY: If you have made your purchase in the United States, this Lifetime Limited Warranty is granted by and this Limitation of Liability is stipulated for the benefit of TickTalk Tech LLC, 565 W. Lambert Rd., Unit B, Brea, CA 92821, USA.

What This Warranty Covers 

TickTalk Tech LLC (“TickTalk”) warrants to the original purchaser (“you”) of the hardware and manufacturing with which this Lifetime Limited Warranty is included (“Hardware”) that the Hardware will be free from defects in workmanship and materials under normal use (“Defects”) for the product lifetime under the original purchaser (“Warranty Period”). During the Warranty Period the Hardware will be repaired or replaced at TickTalk Tech LLC’s discretion (“Limited Warranty”) without charge to you for either parts or labor. This Lifetime Limited Warranty covers the replacement of the Hardware only. TickTalk Tech LLC holds the right to withdraw Lifetime Limited Warranty coverage if replacement and/or repair claims are suspected of being abused or fraudulent. 

TickTalk smartwatches are a generational product, with older models eventually being phased out as new generations are introduced. TickTalk Tech LLC will honor the Limited Lifetime Warranty of past generation TickTalk smartwatches for maintenance for two (2) years after phase out, after which we will honor a trade-in discount for the newest generation instead of repair or replacement. 

Warranty is only valid with purchase from authorized retailers (www.myticktalk.com) and cannot be applied to outside third party purchases. TickTalk Tech LLC reserves the right for final interpretation. Any and all Extended Warranties must be purchased from TickTalk Tech LLC at www.myticktalk.com. No third party Extended Warranties will be honored for replacements from outside marketplaces or websites.

What The Limited Warranty Does Not Cover

The Lifetime Limited Warranty does not apply to normal wear and tear, does not apply when the Hardware is opened or repaired by someone not authorized by TickTalk Tech LLC and does not cover repair or replacement of any Hardware or part thereof damaged by: misuse, moisture, liquids, proximity or exposure to heat and accident, abuse, improper care, the natural breakdown of materials over extended time and use, non-compliance with the instructions supplied with the Hardware, neglect or misapplication. The Lifetime Limited Warranty does not cover physical damage to the surface of the Hardware such as broken glass screens. This Lifetime Limited Warranty does not cover any software that may accompany or be installed on the Hardware. The Lifetime Limited Warranty does not cover the installation, removal or maintenance of the Hardware or any costs related herewith. The Lifetime Limited Warranty does not apply to any third party purchases from non-authorized retailers.

If an item is returned for replacement and/or refund and is heavily used or damaged, is missing any parts, or is damaged during return shipping due to poor packaging, we hold the right to provide a partial refund to account for the loss in the item's value.

What The Extended Warranty Does Not Cover

Extended Warranties cover normal wear and tear including but not limited to breaks, water exposure, broken bands, and shattered screens. Extended Warranty does not cover lost or missing watches and damage that would not occur under normal circumstances including but not limited to heat/fire exposure, pet exposure, hardware disassembly, or when hardware is opened/tampered with. The Extended Warranty does not apply to any third party purchases from non-authorized retailers.

If an item is returned for replacement/refund and is is heavily used/damaged, is missing any parts, or is damaged during return shipping because it wasn't packaged correctly, we hold the right to provide a partial refund to account for the loss in the item's value.

How To Make A Warranty Claim

Please submit our RETURN OR REPLACEMENT FORM on the Contact Page. Follow the instructions for the claim.  In order to make a claim of a Defect, the original purchaser must contact TickTalk Tech LLC during the Warranty Period. You must return the Hardware during the Warranty Period, along with your purchase order/receipt copy, and an explanation of the Defect, to the address provided to you by TickTalk Tech LLC. If a defect arises and a valid claim under this Limited Warranty is received by TickTalk Tech LLC after the first one hundred and eighty (180) days of the Warranty Period, TickTalk Tech LLC is entitled to charge you for any reasonable shipping and handling costs made in connection with the repair or replacement of the Hardware. You must comply with any other return procedures stipulated by TickTalk Tech LLC, if any. Please note that all models are replaced with the same model purchased. If we are out of stock on the color originally purchased, it can be replaced with the color we have available at such time of replacement.

International purchases will be responsible for any shipping costs associated with a warranty return.

Hardware Replacement Fees

For all Hardware defects, TickTalk Tech LLC will adopt Return for Replacement instead of Return for Repair.

If the defects are not covered by the Lifetime Limited Warranty or Extended Warranty, we will offer a replacement model for a $100.00 USD price for any TickTalk 3 and TickTalk 4 models. The customer is responsible for returning and shipping the defective hardware to the address provided at their own costs. 

NOTE: Make sure you pack the product securely and include a copy of your proof of purchase. Ensure the tracking number for the return is clearly visible on the outside of the packaging as well as on the copy of the proof of purchase included inside the box. Ensure your shipping address is on the copy of the proof of purchase included inside the box. Please include all your information to contact you with the returned watch.

Out of Warranty Policy

If you are out of your purchase warranty period of 1 year you are still eligible to get a replacement for a damaged TickTalk 4 and/or TickTalk 5 with a replacement fee of $100.00 USD. We will honor this price for any damaged TickTalk 4 and/or TickTalk 5.  Please note, the TickTalk 4 cannot be replaced for a TickTalk 5 for the $100.00 USD replacement fee. The trade-in program is available for customers who wish to upgrade a damaged TickTalk 4 for the newest generation.

Your Legal Rights

This Lifetime Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state and jurisdiction to jurisdiction.

If any part of this Lifetime Limited Warranty is held to be invalid or unenforceable, the remainder of the Lifetime Limited Warranty shall nonetheless remain in full force and effect.

This Lifetime Limited Warranty is the only express warranty made to you and is provided in lieu of any other express warranties or similar obligations (if any) created by any advertising, documentation, packaging, or other communications.

Except for the Lifetime Limited Warranty and to the maximum extent permitted by applicable law, TickTalk Tech LLC and its suppliers provide the Hardware “AS IS AND WITH ALL FAULTS”, and hereby disclaim all other warranties and conditions, whether express, implied or statutory, including, but not limited to, any (if any) implied warranties, duties or conditions of: merchantability, non-infringement, quiet enjoyment, system integration, satisfactory quality, fitness for a particular purpose, reliability or availability, accuracy or completeness of responses, results, workmanlike effort, lack of viruses, and reasonable care and skill, all with regard to the Hardware, and the provision of or failure to provide support or other services, information, software, and related content through the Hardware or otherwise arising out of the use of the Hardware. This exclusion does not apply to (i) any implied condition as to title and (ii) any implied warranty as to conformity with description. If applicable law requires any implied warranties with respect to the Hardware, all such warranties are limited in duration to ninety (90) days. Some states and/or jurisdictions do not allow limitations on how long an implied warranty lasts, so the above may not apply to you.

This Lifetime Limited Warranty cannot be transferred to any other person.


Limitation of Liability 

Neither TickTalk Tech LLC nor its suppliers shall be liable to you or to any third party for any indirect, incidental, consequential, special or exemplary damages (including in each case, but not limited to, damages for the inability to use the equipment or access data, loss of data, loss of business, loss of profits, business interruption or the like) arising out of the use of or inability to use the Hardware even if TickTalk Tech LLC has been advised of the possibility of such damages.

Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced herein and all direct or general damages in contract or anything else), the entire liability of TickTalk Tech LLC and any of its suppliers shall be limited to the amount actually paid by you for the Hardware.

Notwithstanding the above, neither party’s liability for death or personal injury resulting from its own negligence shall be limited.

Some states and/or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.
