TickTalk Care+ Terms of Use

These TickTalk Care+ Terms of Use (“Terms”) govern the purchase, activation, renewal, cancellation, and use of TickTalk Care+.

TickTalk Care+ is provided by TickTalk Tech LLC (“TickTalk,” “we,” “us,” or “our”).

By purchasing or activating TickTalk Care+, you acknowledge that you have read, understood, and agree to these Terms.

1. About TickTalk Care+

TickTalk Care+ is an optional, prepaid device-protection subscription available for eligible TickTalk smartwatches.

TickTalk Care+ is purchased separately from TickTalk Wireless service. It is not included in, dependent on, or automatically canceled with any TickTalk Wireless plan.

TickTalk Care+ supplements, but does not replace, the applicable TickTalk Limited Manufacturer Warranty.

2. Eligible Devices

TickTalk Care+ is available only for:

  • TickTalk 6; and
  • Later TickTalk smartwatch models that TickTalk expressly identifies as eligible.

TickTalk 5 and earlier TickTalk models are not eligible for TickTalk Care+.

Coverage applies only to the specific eligible device registered when TickTalk Care+ is activated.

TickTalk may require the following information to confirm eligibility:

  • Proof of purchase;
  • Original retail purchase date;
  • Order number;
  • Device model;
  • Device color;
  • IMEI or other device identifier;
  • Device condition; and
  • TickTalk account information.

3. Enrollment Requirements

TickTalk Care+ must be purchased within the enrollment period displayed at the time of purchase or activation.

Unless TickTalk expressly states otherwise, the customer must enroll within thirty (30) days after the original retail purchase date of the eligible device.

TickTalk may require confirmation that the device is fully functional and free from pre-existing damage before approving enrollment.

Damage, defects, or conditions that existed before TickTalk Care+ was purchased or activated are not covered.

TickTalk may reject or cancel enrollment if:

  • The device is not eligible;
  • The enrollment information is inaccurate;
  • The device was purchased from an unauthorized seller;
  • The device already had damage or defects;
  • The enrollment period had expired; or
  • Fraud or material misrepresentation is suspected.

4. Coverage Period

An eligible TickTalk device includes a separate one-year Limited Manufacturer Warranty covering qualifying defects in materials and workmanship.

TickTalk Care+ provides additional protection for eligible accidental physical damage that is not covered by the Limited Manufacturer Warranty.

TickTalk Care+ Extended Protection may remain available for up to twenty-four (24) months from the original retail purchase date of the covered device, provided that:

  • The TickTalk Care+ subscription remains active and in good standing;
  • All required subscription payments are successfully completed;
  • The device remains eligible;
  • The claim complies with these Terms; and
  • Coverage has not otherwise ended or been exhausted.

The twenty-four-month protection period is measured from the original retail purchase date, not from the date the manufacturer warranty expires.

TickTalk Care+ does not create a three-year warranty or guarantee three full years of repair or replacement coverage.

5. What the Limited Manufacturer Warranty Covers

During the applicable one-year Limited Manufacturer Warranty period, qualifying defects in materials or workmanship are handled under the TickTalk Limited Manufacturer Warranty.

Examples may include eligible mechanical, electrical, or hardware failures occurring under normal use.

Manufacturer defects remain subject to the exclusions, procedures, limitations, and remedies in the applicable TickTalk Limited Manufacturer Warranty.

6. What TickTalk Care+ Covers

During the applicable TickTalk Care+ Extended Protection period, TickTalk Care+ may cover accidental physical damage resulting from ordinary handling and use of the covered device.

Examples of potentially covered accidental damage include:

  • Accidental drops;
  • Cracked or shattered watch screens;
  • Accidental impact damage;
  • Accidental liquid or water damage;
  • Damage to the watch housing resulting from an accidental incident;
  • Accidental damage to buttons or external watch components; and
  • Other accidental physical damage approved by TickTalk.

Coverage applies only when the damage affects the normal operation or usability of the covered TickTalk smartwatch.

All claims remain subject to inspection, verification, exclusions, availability, and final approval by TickTalk.

7. What TickTalk Care+ Does Not Cover

TickTalk Care+ does not cover:

  • Loss or theft;
  • A missing or unreturned device;
  • Intentional damage;
  • Fraudulent or staged damage;
  • Damage existing before enrollment;
  • Cosmetic damage that does not affect device functionality;
  • Scratches, discoloration, dents, or surface marks that do not interfere with normal use;
  • Normal wear and tear;
  • Gradual deterioration or natural breakdown of materials;
  • Battery capacity reduction caused by ordinary aging and use;
  • Damage caused by abuse, reckless use, or improper care;
  • Damage caused by fire, excessive heat, chemicals, corrosive substances, or extreme environmental exposure;
  • Damage caused by pets, chewing, crushing, or similar misuse;
  • Damage caused by unauthorized repair, opening, modification, disassembly, or tampering;
  • Damage caused by use contrary to TickTalk instructions;
  • Damage caused by unauthorized software or accessories;
  • Damage to a device with an altered, removed, or unreadable IMEI or serial number;
  • Damage resulting from illegal activity;
  • Service interruptions, network problems, software issues, or cellular coverage problems;
  • Data loss;
  • Shipping damage caused by inadequate return packaging;
  • Replacement of accessories; or
  • Any other condition expressly excluded under these Terms.

8. Accessories Are Not Covered

TickTalk Care+ covers only the eligible TickTalk smartwatch registered under the subscription.

It does not cover accessories or replaceable components, including:

  • Watch bands or wristbands;
  • Band keepers;
  • Protective cases;
  • Screen protectors;
  • Charging cords;
  • Charging cables;
  • Charging adapters;
  • Charging bases;
  • Power bases;
  • Packaging;
  • Decorative accessories; or
  • Other detachable accessories.

An accessory is not covered even if it was included in the original device package.

9. Filing a Claim

To request service under TickTalk Care+, the account holder must contact TickTalk Support and complete the applicable claim or return process.

TickTalk may require:

  • Proof of purchase;
  • Order information;
  • Device IMEI;
  • Photographs or video of the damage;
  • A description of the incident;
  • Diagnostic information;
  • Confirmation of account ownership;
  • Return of the damaged device; and
  • Other information reasonably necessary to evaluate the claim.

The customer must submit the claim while TickTalk Care+ coverage is active.

The customer must follow all return, packaging, shipping, device-reset, account-removal, and security instructions provided by TickTalk.

Failure to return the device or comply with the claim process may result in denial of the claim or additional charges.

10. Inspection and Claim Determination

TickTalk may inspect the returned device and review account, device, claim, and diagnostic information before approving a claim.

TickTalk has the right to determine:

  • Whether the device is eligible;
  • Whether coverage was active when the damage occurred;
  • Whether the damage is covered;
  • Whether an exclusion applies;
  • Whether the device can be repaired;
  • Whether replacement is appropriate;
  • Whether additional information is required; and
  • Whether a claim appears fraudulent, abusive, or inconsistent with these Terms.

Approval of one claim does not guarantee approval of a future claim.

11. Repair, Replacement, or Alternative Resolution

For an approved claim, TickTalk may, at its discretion:

  • Repair the covered device;
  • Replace the covered device;
  • Provide a refurbished or recertified replacement;
  • Provide a device of the same or comparable model;
  • Provide another available color;
  • Provide a successor model when the original model is unavailable;
  • Offer a replacement credit; or
  • Provide another reasonable resolution.

Replacement devices may be new, refurbished, recertified, or previously serviced and will be functionally equivalent or comparable to the covered device.

Exact model, color, packaging, and accessory availability are not guaranteed.

The original damaged device becomes TickTalk’s property when a replacement is provided, unless TickTalk states otherwise.

12. Claim Limits and Abuse

TickTalk Care+ is not an unlimited replacement program.

TickTalk may limit the number or frequency of repairs, replacements, or approved claims based on:

  • The applicable plan details;
  • The nature of the damage;
  • Claim history;
  • Device age;
  • Replacement availability;
  • Evidence of misuse or abuse; and
  • Applicable law.

TickTalk may deny, restrict, suspend, or terminate coverage when claims appear:

  • Fraudulent;
  • Intentionally caused;
  • Repeatedly abusive;
  • Materially inconsistent;
  • Based on false information; or
  • Intended to obtain unauthorized replacements or benefits.

TickTalk may require payment of a disclosed service fee, replacement fee, deductible, shipping charge, or other claim-related charge where permitted and communicated before the claim is completed.

13. Subscription and Billing

TickTalk Care+ is a separate prepaid subscription.

The applicable price and billing frequency will be displayed before purchase.

Subscription fees are charged in advance for each billing period.

Unless canceled earlier, TickTalk Care+ automatically renews using the payment method associated with the customer’s account.

By purchasing TickTalk Care+, you authorize TickTalk or its authorized payment processor to charge:

  • The applicable recurring subscription fee;
  • Applicable taxes; and
  • Any separately authorized claim or service fee.

You are responsible for maintaining accurate billing information and a valid payment method.

If payment cannot be completed, TickTalk may suspend or terminate TickTalk Care+ benefits.

14. Maximum Subscription Duration

A TickTalk Care+ subscription may remain active for a maximum of forty-eight (48) months from the original retail purchase date of the covered device.

The subscription will automatically end no later than the end of the forty-eight-month period.

TickTalk will not continue charging recurring TickTalk Care+ subscription fees after the maximum subscription period ends.

The first twenty-four months and the later subscription period may provide different benefits, as explained in these Terms.

15. Cancellation

You may cancel TickTalk Care+ through the applicable TickTalk account or another cancellation method made available by TickTalk.

You are responsible for separately canceling TickTalk Care+ when you no longer want the subscription.

The following actions do not automatically cancel TickTalk Care+:

  • Canceling TickTalk Wireless;
  • Changing a TickTalk Wireless plan;
  • Deactivating an eSIM;
  • Returning the device;
  • Replacing the device;
  • Sending the device for repair;
  • Deleting the TickTalk app;
  • Resetting the device;
  • Discontinuing use of the device; or
  • Closing a separate wireless-service subscription.

Cancellation prevents future recurring charges.

Unless otherwise required by law, coverage and available benefits may continue through the end of the prepaid billing period.

16. Refunds

TickTalk Care+ subscription fees are prepaid and generally nonrefundable once a billing period has begun.

Except where required by applicable law or expressly approved by TickTalk, we do not provide prorated refunds or credits for:

  • Unused coverage;
  • Partial billing periods;
  • Failure to use TickTalk Care+;
  • Cancellation during a prepaid period;
  • A device being returned, exchanged, repaired, replaced, lost, or no longer used;
  • Cancellation of TickTalk Wireless;
  • An ineligible or denied claim; or
  • Expiration or discontinuation of an optional promotional benefit.

Canceling TickTalk Care+ stops future charges but does not ordinarily result in a refund for the remaining portion of the current prepaid billing period.

17. Effect of Device Return, Replacement, or Transfer

TickTalk Care+ applies only to the registered covered device.

Returning a device for a refund does not automatically cancel TickTalk Care+.

When TickTalk replaces a covered device under an approved claim, TickTalk may transfer the remaining eligible coverage to the approved replacement device.

Coverage does not automatically transfer to:

  • A device purchased separately;
  • A device obtained from another seller;
  • A second TickTalk device;
  • A family member’s device; or
  • A privately resold device.

TickTalk Care+ is generally nontransferable and is intended for the original purchaser and registered covered device.

18. Loyalty Protection Benefits After 24 Months

After the initial twenty-four-month Extended Protection period expires, customers who maintain an active TickTalk Care+ subscription may be eligible for optional Loyalty Protection Benefits.

Loyalty Protection Benefits are not extended-warranty coverage and do not guarantee free repair or replacement.

Optional benefits may include:

  • Discounted replacement devices;
  • Reduced replacement service fees;
  • Upgrade credits toward newer TickTalk devices;
  • Exclusive upgrade offers;
  • Priority customer support; or
  • Other promotional benefits offered by TickTalk.

The availability, value, eligibility requirements, fees, credits, participating models, inventory, and terms of any Loyalty Protection Benefit may vary.

TickTalk may introduce, modify, replace, suspend, or discontinue optional Loyalty Protection Benefits, subject to applicable law.

Maintaining an active TickTalk Care+ subscription does not guarantee that any specific Loyalty Protection Benefit will be offered.

19. Loyalty Replacement Devices

When available, TickTalk may offer an eligible customer a replacement device at a reduced loyalty replacement fee.

Replacement model, color, condition, price, and availability are determined by TickTalk based on inventory and program terms.

A loyalty replacement may be:

  • New;
  • Refurbished;
  • Recertified;
  • A comparable model; or
  • A successor model.

A Loyalty Replacement Benefit is not a free warranty replacement unless TickTalk expressly states otherwise.

20. Optional Upgrade Offers

Eligible customers may receive optional upgrade credits or promotional pricing toward a newer TickTalk device.

Upgrade benefits:

  • Are nontransferable;
  • Have no cash value;
  • May expire;
  • May be limited to specific devices;
  • May require return or trade-in of the existing device;
  • May not be combined with another promotion; and
  • May be changed or discontinued.

21. Benefit Coordination

Loyalty Protection Benefits are intended to provide either replacement assistance or upgrade assistance for the same covered device.

A device or account that receives a Loyalty Replacement Benefit may become ineligible for:

  • Upgrade credits;
  • Trade-in benefits;
  • Promotional upgrade pricing; or
  • Another overlapping benefit during the same benefit period.

Similarly, a device that receives an upgrade credit, trade-in benefit, or promotional upgrade may no longer qualify for a Loyalty Replacement Benefit.

TickTalk may determine eligibility and prevent duplicate, overlapping, or repeated benefits.

22. Service Availability

TickTalk does not guarantee:

  • That every damaged device can be repaired;
  • That the same model or color will remain available;
  • That replacement inventory will always be available;
  • That a claim will be completed within a specific time;
  • That an optional loyalty benefit will be offered; or
  • That future products will remain compatible with the covered device or account.

Service may be affected by inventory, shipping, parts availability, model discontinuation, geographic limitations, legal requirements, or circumstances outside TickTalk’s reasonable control.

23. Geographic Availability

Unless expressly stated otherwise, TickTalk Care+ is available only for eligible devices purchased and used in the United States.

International customers may be responsible for shipping, duties, taxes, customs charges, or other costs associated with a claim.

TickTalk may decline claims where shipping, legal, regulatory, or operational restrictions prevent service.

24. Privacy

Information collected and used in connection with TickTalk Care+ is governed by the TickTalk Care+ Privacy Policy and any other applicable TickTalk Privacy Policy.

TickTalk may process account, device, subscription, payment, diagnostic, claim, repair, replacement, shipping, and customer-support information to administer TickTalk Care+.

25. Disclaimer

TickTalk Care+ is provided subject to these Terms and the specific limitations stated in the applicable plan details.

To the fullest extent permitted by law, TickTalk does not guarantee that:

  • Every claim will qualify;
  • Every device will be repairable;
  • An identical replacement will be available;
  • Data stored on a damaged device can be recovered; or
  • Service will be uninterrupted or error-free.

Nothing in these Terms limits any warranty, consumer-protection right, or remedy that cannot lawfully be limited or excluded.

26. Limitation of Liability

To the fullest extent permitted by applicable law, TickTalk will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to TickTalk Care+.

This includes damages relating to:

  • Loss of use;
  • Loss of data;
  • Lost communications;
  • Lost location history;
  • Delayed repair or replacement;
  • Shipping delays;
  • Replacement-device availability; or
  • Inability to use a device while a claim is being processed.

To the fullest extent permitted by law, TickTalk’s total liability arising specifically from TickTalk Care+ will not exceed the total TickTalk Care+ subscription fees paid for the covered device during the twelve months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the limitation applies only to the extent permitted by law.

27. Changes to These Terms

TickTalk may update these Terms to reflect changes in:

  • TickTalk Care+;
  • Eligible devices;
  • Coverage procedures;
  • Claim processes;
  • Subscription billing;
  • Optional loyalty benefits;
  • Legal requirements; or
  • Business operations.

When we update these Terms, we will revise the “Last Updated” date.

Where required by law, we will provide advance notice of material changes and obtain any additional consent required.

Changes will not reduce already-earned benefits for a previously approved claim, except where permitted by law.

28. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

Nothing in these Terms limits any nonwaivable rights available under applicable federal, state, or local law.

29. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

30. Entire Agreement

These Terms, the applicable plan and checkout disclosures, the TickTalk Care+ Privacy Policy, the TickTalk Limited Manufacturer Warranty, and any claim-specific written agreement form the entire agreement concerning TickTalk Care+.

If a specific checkout disclosure directly conflicts with these Terms, the checkout disclosure will control for that purchase only to the extent of the conflict.
