TickTalk Radio Terms of Use

These Terms of Use (“Terms”) govern your purchase of, access to, and use of TickTalk Radio, including its music stations, wellness content, subscription features, and related services.
TickTalk Radio is provided by TickTalk Tech LLC (“TickTalk,” “we,” “us,” or “our”). By starting a TickTalk Radio subscription, accessing TickTalk Radio, or allowing a child to use the service through your parent-managed TickTalk account, you agree to these Terms.
Please review these Terms carefully before purchasing or using TickTalk Radio. Our collection and use of information in connection with the service are described separately in the TickTalk Radio Privacy Policy.
1. Parent-Managed Service
TickTalk Radio is a parent-managed service designed for children using an eligible TickTalk device and TickTalk account.
A parent or legal guardian must purchase, activate, and manage the TickTalk Radio subscription. The parent or legal guardian is responsible for:
- Selecting the child’s appropriate age group;
- Reviewing the stations made available for that age group;
- Enabling or disabling individual stations;
- Managing the child’s access to TickTalk Radio;
- Maintaining accurate account and payment information; and
- Canceling the subscription when it is no longer wanted or needed.
Children may not independently purchase, activate, or manage a TickTalk Radio subscription.
2. Subscription and Billing
TickTalk Radio is offered as a prepaid subscription unless otherwise stated in connection with a promotion, trial, or special offer.
The applicable subscription price, available features, promotional terms, and any other material billing information will be displayed before you complete your purchase.
Subscription fees are charged in advance for each 30-day billing period. Because TickTalk Radio uses a 30-day billing cycle rather than a calendar-month billing cycle, your billing date may not fall on the same calendar date each month.
Applicable taxes may be added to the subscription price where required by law.
3. Automatic Renewal Authorization
Unless you cancel before the next scheduled billing date, your TickTalk Radio subscription will automatically renew at the end of each 30-day billing period.
By starting a subscription, you authorize TickTalk or its authorized payment processor to charge the applicable subscription fee, plus any required taxes, to the payment method associated with your account at the beginning of each new 30-day billing period until you cancel.
You are responsible for maintaining a valid payment method and accurate billing information. If a payment cannot be processed, TickTalk may suspend or discontinue access to TickTalk Radio until payment is successfully completed.
If the subscription price changes, we will provide notice before the new price applies where required by law. Continuing the subscription after the effective date of the price change constitutes acceptance of the updated price, subject to applicable law.
4. Cancellation
You may cancel TickTalk Radio through the subscription-management section of your TickTalk parent account or through another cancellation method made available by TickTalk.
You are responsible for canceling the subscription before the next scheduled billing date if you do not want to be charged for another 30-day billing period.
Cancellation stops future automatic-renewal charges. After cancellation, you may continue using TickTalk Radio through the end of the prepaid 30-day billing period for which payment has already been made. Access will end when that prepaid billing period expires.
The following actions do not automatically cancel your TickTalk Radio subscription:
- Deleting the TickTalk app;
- Resetting or discontinuing use of a TickTalk device;
- Deactivating or canceling a wireless service plan;
- Returning a TickTalk device for a refund;
- Sending a device to TickTalk for repair or replacement;
- Exchanging or replacing a device; or
- Losing access to, damaging, or no longer using the associated device.
If you return, replace, repair, exchange, deactivate, or stop using a TickTalk device, you must separately cancel the TickTalk Radio subscription through your parent account if you do not want the subscription to renew.
5. Refunds
TickTalk Radio subscription fees are prepaid and generally nonrefundable once a 30-day billing period has begun.
Except where required by applicable law or expressly approved by TickTalk, we do not provide prorated refunds, credits, or reimbursements for:
- Unused or partially used time within a prepaid billing period;
- Failure to use TickTalk Radio;
- Cancellation before the end of the current billing period;
- A child no longer using the service;
- A device being lost, damaged, reset, deactivated, repaired, replaced, returned, or exchanged;
- Cancellation or interruption of a separate wireless service plan; or
- Dissatisfaction with an individual song, artist, station, genre, or content selection.
Canceling your subscription prevents charges for future billing periods but does not result in a refund or credit for the remaining portion of the current prepaid billing period.
6. Promotions and Trial Offers
TickTalk may offer promotional pricing, introductory offers, free trials, or other limited-time benefits. Eligibility, duration, pricing, renewal terms, and other conditions will be disclosed when the offer is presented.
Unless otherwise stated, a promotional or trial subscription may automatically convert to a paid subscription at the end of the promotional or trial period. You must cancel before the stated renewal date if you do not want to be charged.
Promotional offers may be limited to eligible customers, accounts, devices, regions, or time periods and may not be combined with other offers unless expressly stated.
7. Station-Based Listening Experience
TickTalk Radio provides a station-based listening experience rather than an on-demand music service.
Songs and other content are selected and played as part of a station’s curated and programmed rotation. Users cannot:
- Search for and immediately play a specific song on demand;
- Select the exact order in which songs are played;
- Create personal on-demand playlists;
- Download songs or other licensed content;
- Save music for offline listening; or
- Copy, extract, record, or redistribute music through the service.
Songs within a station may be played in a randomized or otherwise programmed sequence. The order and frequency of songs may change over time.
8. Age Groups and Content Curation
TickTalk Radio makes stations available based on the child’s age group selected by the parent or legal guardian.
TickTalk carefully reviews and curates the songs and other content made available within each age group with the goal of providing an age-appropriate listening experience.
Parents may preview available stations and disable individual stations they do not want their child to access.
Families may have different standards regarding lyrics, themes, artists, genres, subject matter, and age appropriateness. Although TickTalk takes reasonable steps to review and curate content, we cannot guarantee that every parent or child will consider every song or other item appropriate or suitable.
Parents remain responsible for selecting the appropriate age group, reviewing the available stations, and managing their child’s access.
9. Favorites, Likes, and Sharing
TickTalk Radio may allow children to mark stations as favorites and to like songs or other content. These selections may be used to make favorite stations easier to find, understand which content is popular, improve station curation, and support the operation of the service.
Where enabled, a child may share a station or content recommendation with an approved TickTalk friend or contact.
Sharing a station or content recommendation does not transmit, copy, download, or transfer the underlying music file. Sharing is limited to TickTalk-supported features and approved TickTalk contacts and remains subject to applicable parental controls.
10. Content Feedback and Reporting
If you believe that a song, artist, station, title, image, or other content may not be appropriate for its intended age group, or if you have a content suggestion, please contact support@myticktalk.com.
When available, please include the station name, song title, artist, approximate date and time the content was heard, and a brief description of your concern or suggestion.
TickTalk may review reported content and may remove, restrict, replace, reclassify, or otherwise modify content at its discretion.
11. Content and Feature Availability
Stations, songs, artists, wellness content, features, and other programming may change over time.
TickTalk may add, remove, replace, update, suspend, limit, or reorganize content or features without prior notice because of:
- Content-review or curation decisions;
- Music or content-licensing requirements;
- Geographic restrictions;
- Device or software compatibility;
- Third-party provider availability;
- Network or technical requirements;
- Security or legal requirements; or
- Other operational reasons.
Subscription to TickTalk Radio does not guarantee the continued availability of any particular song, artist, station, feature, or category.
12. Device, Account, and Connectivity Requirements
Use of TickTalk Radio may require:
- A compatible TickTalk device;
- A valid parent-managed TickTalk account;
- An active TickTalk Radio subscription;
- Current device and application software;
- An active cellular or Wi-Fi connection; and
- Any other technical requirements displayed by TickTalk.
Wireless service, internet access, compatible equipment, and related charges may be separate from the TickTalk Radio subscription.
Playback quality and service availability may be affected by network coverage, internet availability, signal strength, device condition, software version, maintenance, and circumstances outside TickTalk’s control.
13. Third-Party Content and Technology Providers
TickTalk works with third-party music, licensing, content-delivery, hosting, payment, analytics, and technology providers to operate TickTalk Radio.
Music, artwork, artist names, recordings, compositions, and related materials remain the property of their respective owners and rights holders.
Your subscription provides only a limited, personal, nonexclusive, nontransferable, revocable right to access TickTalk Radio and its available content in accordance with these Terms. No ownership rights in any music or other licensed content are transferred to you.
14. Permitted Use
TickTalk Radio and its content are provided solely for personal, noncommercial use by eligible TickTalk users.
You may not:
- Copy, capture, record, download, reproduce, extract, rip, distribute, transmit, sell, sublicense, or publicly perform any music or other content;
- Use TickTalk Radio or its content for a public, commercial, promotional, or business purpose;
- Circumvent station controls, access restrictions, playback limitations, or other technical protections;
- Attempt to access, identify, extract, or reconstruct the underlying music or content library;
- Use automated systems, bots, scripts, crawlers, scraping tools, or data-mining tools to access or analyze the service or its content;
- Reverse engineer, decompile, disassemble, modify, or interfere with TickTalk Radio or its related software, systems, or technology;
- Attempt to gain unauthorized access to another account, device, system, or network;
- Use the service in a fraudulent, unlawful, abusive, or harmful manner; or
- Use TickTalk Radio in a manner that infringes copyrights, privacy rights, intellectual-property rights, or other rights.
15. Ownership and Intellectual Property
TickTalk Radio, including its software, interface, design, branding, graphics, text, station organization, and related technology, is owned by TickTalk or its licensors and is protected by applicable intellectual-property laws.
“TickTalk,” “TickTalk Radio,” associated logos, and related names and designs are trademarks or other protected properties of TickTalk. You may not use them without prior written permission.
Nothing in these Terms grants you permission to use any music, recording, composition, artwork, trademark, copyright, or other intellectual property except as necessary for personal access to TickTalk Radio through its intended features.
16. Suspension or Termination
TickTalk may suspend, restrict, or terminate access to TickTalk Radio if:
- Subscription fees are not successfully paid;
- You violate these Terms;
- The service or an account is used in a fraudulent, abusive, unlawful, or unauthorized manner;
- Suspension is reasonably necessary to protect users, children, TickTalk, service providers, or the security of the service;
- A licensing, legal, technical, or operational requirement prevents continued service; or
- TickTalk discontinues TickTalk Radio or a material part of the service.
Where reasonably practicable and required by applicable law, TickTalk will provide notice of a suspension, termination, or discontinuation.
Termination resulting from a violation of these Terms does not entitle you to a refund, except where required by applicable law.
17. Service Interruptions and Disclaimer
TickTalk takes reasonable steps to provide a reliable service, but TickTalk Radio may occasionally be unavailable, delayed, interrupted, or affected by maintenance, network conditions, software issues, licensing changes, third-party service interruptions, security events, or circumstances outside TickTalk’s reasonable control.
To the fullest extent permitted by applicable law, TickTalk Radio is provided on an “as is” and “as available” basis. TickTalk does not guarantee uninterrupted or error-free operation, continuous availability of any particular content, or that every song or station will meet the preferences or standards of every family.
Nothing in these Terms excludes or limits warranties, rights, or remedies that cannot lawfully be excluded or limited.
18. Limitation of Liability
To the fullest extent permitted by applicable law, TickTalk and its officers, employees, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to TickTalk Radio, including loss of data, loss of use, service interruption, or inability to access particular content.
To the fullest extent permitted by applicable law, TickTalk’s total liability for claims arising from or relating specifically to TickTalk Radio will not exceed the amount you paid for TickTalk Radio during the six months immediately preceding the event giving rise to the claim.
Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, these limitations apply only to the extent permitted by applicable law.
19. Changes to These Terms
TickTalk may update these Terms from time to time to reflect changes to TickTalk Radio, subscription features, billing practices, legal requirements, licensing arrangements, service providers, or our business operations.
When we update these Terms, we will revise the “Last Updated” date at the top of this page.
Where required by applicable law, we will provide advance notice of material changes and request any additional consent required before the changes take effect.
Your continued use of TickTalk Radio after updated Terms take effect constitutes acceptance of the updated Terms, except where applicable law requires another form of consent.
20. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent that applicable consumer-protection law requires otherwise.
Nothing in these Terms limits any nonwaivable rights or remedies available to you under applicable federal, state, or local law.
21. Severability and Waiver
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
TickTalk’s failure to enforce any provision of these Terms does not waive its right to enforce that provision or any other provision in the future.
