TickTalk Radio Terms of Use

These TickTalk Radio Terms of Use (“Terms”) govern the purchase, access, and use of TickTalk Radio, including its music stations, wellness content, subscription features, and related services. TickTalk Radio is provided by TickTalk Tech LLC (“TickTalk,” “we,” “us,” or “our”). By purchasing, activating, or using TickTalk Radio through a parent-managed TickTalk account, you agree to these Terms.
TickTalk Radio is currently available only for eligible TickTalk 6 devices and accounts. TickTalk 4 and TickTalk 5 are not eligible for TickTalk Radio under these Terms.
Our collection and use of Personal Information in connection with TickTalk Radio are described in the TickTalk Privacy Policy.
1. Parent-Managed Service
TickTalk Radio is a parent-managed service designed for children using an eligible TickTalk 6 device. A parent or legal guardian must purchase, activate, and manage any paid TickTalk Radio subscription or eligible TickTalk Wireless plan that includes TickTalk Radio.
The parent or legal guardian is responsible for selecting the child’s age group, reviewing available stations, enabling or disabling stations where supported, managing access, maintaining accurate account and payment information, and managing or canceling paid subscriptions. Children may not independently purchase or manage a TickTalk Radio subscription.
2. Eligibility and Ways to Access TickTalk Radio
TickTalk Radio is currently available for eligible TickTalk 6 accounts through either of the following:
- TickTalk Wireless Essential: TickTalk Radio is optional and may be added as a separate monthly subscription at any time while the account remains eligible.
- TickTalk Wireless Premium: TickTalk Radio is included as a benefit of the Premium plan while the Premium plan remains active and eligible. No separate TickTalk Radio subscription fee applies while Radio is provided through Premium.
Eligibility may depend on device, account, software, plan, territory, licensing, and service availability. TickTalk may verify eligibility before activating or continuing TickTalk Radio.
3. Standalone TickTalk Radio Price
For eligible TickTalk Wireless Essential customers, the current standalone TickTalk Radio price is $4.99 per month; the regular price is $6.99 per month, plus applicable taxes.
The price displayed and affirmatively accepted by the adult account holder at the time of purchase controls for that purchase. TickTalk may change the standalone subscription price in the future. Where required by law, TickTalk will provide advance notice of a fee change and information about how to cancel before the new price takes effect.
4. Monthly Billing and Automatic Renewal
A standalone TickTalk Radio subscription is a monthly recurring subscription. It begins on the date the adult account holder successfully purchases or activates the subscription and renews monthly until canceled, unless it ends earlier because the account becomes ineligible or these Terms otherwise permit termination.
The TickTalk Radio billing cycle is separate from the TickTalk Wireless billing cycle and generally renews based on the Radio subscription start date. Billing dates may vary in limited circumstances based on payment processing or calendar-month differences.
By purchasing a standalone TickTalk Radio subscription, you authorize TickTalk or its authorized payment processor to charge the applicable monthly subscription fee and taxes to the payment method associated with your account until automatic renewal is canceled.
Before enrollment, TickTalk will present the material recurring-subscription terms and obtain the adult account holder’s affirmative consent. A confirmation or acknowledgment of the subscription and cancellation information will be provided in a form that can be retained where required by law.
5. Adding TickTalk Radio to Essential
An eligible Essential customer may add TickTalk Radio at any time. The standalone subscription starts when the purchase is successfully completed and is not required to begin on the same date as the Essential wireless plan.
6. Upgrading from Essential to Premium
If an account with an active standalone TickTalk Radio subscription upgrades from TickTalk Wireless Essential to TickTalk Wireless Premium, the standalone TickTalk Radio recurring subscription will be automatically stopped so that the account is not charged a separate Radio subscription fee going forward. TickTalk Radio access will then be provided as part of the Premium plan for as long as the Premium plan remains active and eligible.
No new standalone Radio subscription is required during the active Premium plan. Any refund or credit for an already-paid standalone billing period is subject to the refund provisions below, the plan-change flow presented to the customer, and applicable law.
7. Canceling or Downgrading Premium
If a Premium plan is canceled, expires, becomes inactive, or is downgraded to Essential, access to TickTalk Radio that was included through Premium will end when the Premium entitlement ends.
TickTalk will not automatically start a separate paid TickTalk Radio subscription. If the account becomes eligible for standalone TickTalk Radio under Essential and the adult account holder wants to continue Radio, the adult must affirmatively purchase the standalone monthly subscription.
8. Canceling a Standalone TickTalk Radio Subscription
You may turn off automatic renewal of a standalone TickTalk Radio subscription at any time through the online subscription-management options provided in the TickTalk App, including through My Services, or through another cancellation method made available by TickTalk.
Canceling automatic renewal stops future standalone Radio charges. Unless applicable law requires otherwise, Radio access remains available through the end of the current paid monthly billing period and then ends.
Where applicable law provides a right to immediate termination, refund of unearned amounts, or another cancellation remedy, TickTalk will honor those rights.
Deleting the TickTalk App, resetting or replacing a device, or simply ceasing to use TickTalk Radio does not by itself constitute a request to cancel automatic renewal. Customers should use the cancellation method provided in the TickTalk App or another method made available by TickTalk.
9. Wireless Plan Eligibility Changes
Standalone TickTalk Radio is currently offered as an optional service for eligible TickTalk 6 accounts using TickTalk Wireless Essential. If the underlying eligible wireless plan ends or the account otherwise becomes ineligible, TickTalk Radio access may end and TickTalk may stop future standalone Radio billing. Ending Radio does not itself reactivate, extend, or modify a wireless plan.
10. Refunds
Standalone TickTalk Radio subscription fees are generally nonrefundable once a monthly billing period has begun, except where required by applicable law or expressly approved by TickTalk.
Except where required by law, we do not provide prorated refunds or credits for unused or partially used time, failure to use the service, cancellation during a paid billing period, dissatisfaction with an individual song or station, or a change in device usage.
11. Promotions, Trials, and Price Changes
TickTalk may offer promotional pricing, trials, credits, or other limited-time benefits. Any special eligibility, duration, renewal, conversion, or pricing terms will be disclosed when the offer is presented.
If a promotional or trial offer automatically converts to a paid subscription, TickTalk will disclose the conversion and renewal terms before enrollment and provide any notices required by applicable law.
For an existing paid subscription, TickTalk will provide legally required advance notice before a material fee change takes effect and will include information about how to cancel.
12. Station-Based Listening Experience
TickTalk Radio provides a curated, station-based listening experience rather than a fully on-demand music catalog. Songs and other content are selected and played as part of programmed station rotations.
Unless a feature expressly states otherwise, users cannot search for and immediately play any song on demand, control the exact playback order, create unrestricted on-demand playlists, download licensed songs for offline use, or copy, extract, record, or redistribute licensed content.
13. Age Groups, Curation, and Parental Controls
TickTalk Radio may make stations available based on the age group selected by the parent or legal guardian. TickTalk reviews and curates available music, audio, and wellness content with the goal of providing an age-appropriate experience.
Parents may review available stations and manage access using supported parental controls. Families may have different standards regarding lyrics, themes, artists, genres, and age appropriateness. TickTalk cannot guarantee that every parent will consider every item suitable for every child, so parents remain responsible for reviewing and managing their child’s access.
14. Favorites, Likes, Sharing, and Feedback
Where supported, TickTalk Radio may allow a child to favorite stations, like content, or share a station or recommendation through approved TickTalk features and contacts. These functions do not transfer ownership of or provide a downloadable copy of the underlying licensed content.
If you believe content may not be appropriate for its intended age group, or if you have a content suggestion, contact support@myticktalk.com. TickTalk may review, remove, restrict, replace, or reclassify content at its discretion.
15. Content, Territory, and Feature Availability
Stations, songs, artists, wellness content, features, and programming may change over time. Availability may vary by territory and may be affected by music or content licensing, device compatibility, software version, account configuration, provider availability, network conditions, security requirements, or law.
TickTalk may add, remove, replace, update, suspend, limit, or reorganize content or features. A TickTalk Radio subscription does not guarantee continued availability of any particular song, artist, station, category, or feature.
16. Device, Software, and Connectivity Requirements
Use of TickTalk Radio may require an eligible TickTalk 6 device, a parent-managed TickTalk account, current device and App software, an eligible TickTalk Wireless plan or standalone Radio entitlement, and an active cellular or Wi-Fi connection.
Playback quality and service availability may be affected by network coverage, internet availability, signal strength, device condition, software version, maintenance, and circumstances outside TickTalk’s reasonable control.
17. Third-Party Content, Licensing, and Intellectual Property
TickTalk works with music, licensing, content-delivery, hosting, payment, and technology providers to operate TickTalk Radio. Music, recordings, compositions, artwork, artist names, and related materials remain the property of their respective owners and rights holders.
Your access to TickTalk Radio provides only a limited, personal, nonexclusive, nontransferable, revocable right to use the service and available content for personal, noncommercial use in accordance with these Terms. No ownership rights in music or other licensed content are transferred to you.
18. Prohibited Uses
You may not copy, record, download, reproduce, extract, rip, distribute, sell, sublicense, publicly perform, or commercially exploit licensed content; circumvent playback or access restrictions; scrape or data-mine the service; reverse engineer or interfere with the service; gain unauthorized access to accounts or systems; or use TickTalk Radio in a fraudulent, unlawful, abusive, or infringing manner.
19. Failed Payments, Suspension, and Termination
You are responsible for maintaining a valid payment method for any standalone paid subscription. If a payment cannot be processed, TickTalk may suspend or end standalone TickTalk Radio access until payment is successfully completed.
TickTalk may also suspend, restrict, or terminate access for violation of these Terms, fraud, abuse, security concerns, licensing or legal requirements, loss of eligibility, or discontinuation of the service. Where required by applicable law, TickTalk will provide required notice.
20. Service Interruptions and Disclaimer
TickTalk takes reasonable steps to provide a reliable service, but TickTalk Radio may occasionally be unavailable, delayed, interrupted, or affected by maintenance, network conditions, software issues, licensing changes, third-party interruptions, security events, or circumstances outside TickTalk’s reasonable control.
To the fullest extent permitted by applicable law, TickTalk Radio is provided on an “as is” and “as available” basis. Nothing in these Terms excludes or limits warranties, consumer rights, or remedies that cannot lawfully be excluded or limited.
21. Limitation of Liability
To the fullest extent permitted by applicable law, TickTalk and its officers, employees, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to TickTalk Radio, including loss of data, loss of use, service interruption, or inability to access particular content.
To the fullest extent permitted by applicable law, TickTalk’s total liability for claims arising specifically from a standalone TickTalk Radio subscription will not exceed the amount paid for TickTalk Radio during the six months immediately preceding the event giving rise to the claim. Where applicable law does not permit a limitation, the limitation applies only to the extent permitted.
22. Privacy
Personal Information processed in connection with TickTalk Radio is handled under the TickTalk Privacy Policy. TickTalk Radio does not have a separate privacy policy.
23. Changes to These Terms
TickTalk may update these Terms to reflect changes in TickTalk Radio, subscription features, billing practices, legal requirements, licensing arrangements, providers, or business operations. We will update the “Last Updated” date when these Terms change.
Where required by applicable law, TickTalk will provide advance notice of material changes or fee changes and request any additional consent required before the change takes effect.
24. Governing Law and Severability
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.
If any provision is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
