TickTalk Wireless Terms of Use

These Terms of Use (“Terms”) govern your purchase of, access to, and use of TickTalk Wireless services, including wireless voice, messaging, data, SIM and eSIM services, subscription plans, account-management tools, and related features and services.
TickTalk Wireless is provided by TickTalk Tech LLC, doing business as TickTalk Wireless (“TickTalk,” “we,” “us,” or “our”).
By selecting a wireless plan, activating service, creating or using a TickTalk Wireless account, or allowing a child to use the service through your parent-managed TickTalk account, you acknowledge that you have read, understood, and agree to these Terms.
Please read these Terms carefully. If you do not agree to them, you may not activate or use TickTalk Wireless.
These Terms incorporate by reference our:
- TickTalk Wireless Fair Use Policy;
- Privacy Policy;
- applicable plan details and pricing disclosures; and
- any additional terms presented when you purchase or activate a particular service.
Use of TickTalk Radio is also subject to the separate TickTalk Radio Terms of Use and TickTalk Radio Privacy Policy.
1. Parent-Managed Service
TickTalk Wireless is intended to provide wireless connectivity for compatible TickTalk smartwatches and related TickTalk services.
A parent or legal guardian must purchase, activate, and manage the wireless subscription for a child. The parent or legal guardian is responsible for:
- selecting the appropriate wireless plan;
- providing accurate account and payment information;
- managing the child’s TickTalk device and account;
- supervising the child’s use of calling, messaging, data, location, emergency, and other connected features;
- reviewing applicable plan limitations and coverage;
- maintaining the security of the parent account; and
- canceling the subscription when it is no longer wanted or needed.
Children may not independently purchase, activate, change, or cancel a TickTalk Wireless plan.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or manage TickTalk Wireless service.
By creating or using an account, you represent that:
- the information you provide is accurate and complete;
- you are authorized to use the payment method associated with the account;
- you are the child’s parent, legal guardian, or an adult authorized by the parent or legal guardian;
- you will comply with these Terms and all applicable laws; and
- you have not previously been prohibited from using TickTalk Wireless because of fraud, abuse, nonpayment, or another material violation.
TickTalk Wireless is offered primarily for use within the United States unless a plan or feature expressly states that international use or roaming is supported.
3. TickTalk Wireless Service
TickTalk Wireless provides eligible TickTalk devices with access to wireless voice, messaging, data, and related connected services based on the plan selected by the parent or account holder.
Available features may include:
- voice calling;
- text, voice, image, or app-based messaging;
- cellular data;
- real-time GPS location services;
- SOS and emergency-calling features;
- parent-controlled communication;
- cloud-related services;
- TickTalk Radio access, when included in the selected plan; and
- other features described in the applicable plan details.
Specific features may vary by:
- selected plan;
- TickTalk device model;
- operating-system version;
- geographic location;
- network coverage;
- account status;
- software availability; and
- applicable carrier or technology limitations.
4. Account Registration and Security
You may be required to create a TickTalk account to purchase, activate, manage, or use TickTalk Wireless.
You agree to:
- provide accurate, current, and complete information;
- promptly update information that changes;
- maintain the confidentiality of your login credentials;
- use a strong and unique password;
- prevent unauthorized access to your account; and
- notify TickTalk promptly if you suspect unauthorized access, fraud, or a security breach.
You are responsible for activity conducted through your account unless applicable law provides otherwise.
TickTalk may require identity, account, device, or payment verification before processing certain requests, including activation, number transfer, cancellation, account recovery, or changes to account ownership.
5. Compatible Devices
TickTalk Wireless service may be used only with devices that TickTalk identifies as compatible with the applicable plan, SIM, eSIM, network, and service features.
Compatibility may depend on:
- device model;
- device software;
- supported radio-frequency bands;
- SIM or eSIM configuration;
- device certification;
- network technology;
- geographic location; and
- carrier requirements.
TickTalk does not guarantee that service will work with devices that have been altered, rooted, jailbroken, modified, damaged, improperly repaired, or used with unauthorized software.
You may not attempt to bypass device-compatibility requirements or activate TickTalk Wireless on an unauthorized device.
6. SIM and eSIM Use
Any physical SIM card or eSIM profile provided for TickTalk Wireless is intended solely for use with the compatible TickTalk device and service for which it was issued.
You may not:
- remove and use a TickTalk Wireless SIM in an unauthorized phone, tablet, hotspot, router, modem, computer, or other device;
- transfer, duplicate, copy, clone, resell, or distribute a SIM or eSIM profile;
- modify or tamper with a SIM, eSIM profile, device identifier, IMEI, or activation credential;
- use a TickTalk Wireless SIM or eSIM to provide connectivity to another device;
- use the service for tethering or mobile-hotspot purposes unless expressly permitted; or
- use the SIM or eSIM in a manner inconsistent with the selected plan.
If we detect that a SIM or eSIM is being used in an unauthorized device or manner, we may restrict, suspend, or terminate service.
The SIM card or eSIM profile remains subject to TickTalk’s activation, security, network, and account-management requirements.
7. Wireless Plans
Available wireless plans, prices, included services, and plan limitations will be displayed before purchase or activation.
Plans may include limited or unlimited allowances for:
- voice calls;
- text or app-based messaging;
- cellular data;
- TickTalk Radio;
- cloud services; and
- other connected features.
The services included in a plan apply only to normal, personal, noncommercial use through an eligible TickTalk device.
“Unlimited” does not mean that the service may be used for any purpose, on any device, or without reasonable network-management and abuse-prevention measures. Unlimited plans remain subject to these Terms and the TickTalk Wireless Fair Use Policy.
8. Premium Plan and TickTalk Radio
The TickTalk Wireless Premium Plan may include TickTalk Radio as part of the plan benefits.
Access to TickTalk Radio requires:
- an active eligible Premium Plan;
- a compatible TickTalk device;
- an active TickTalk account;
- network connectivity; and
- compliance with the TickTalk Radio Terms of Use.
TickTalk Radio access included with the Premium Plan has no separate cash value and may not be transferred, resold, exchanged, or redeemed for a refund or credit.
If the Premium Plan is canceled, suspended, terminated, downgraded, or not successfully renewed, access to TickTalk Radio may end when the applicable paid service period expires.
The availability of particular stations, songs, artists, wellness content, or TickTalk Radio features is not guaranteed and may change over time.
9. Coverage and Network Availability
TickTalk Wireless relies on underlying wireless networks, carriers, roaming partners, infrastructure providers, and technology service providers.
Coverage maps, availability estimates, and signal indicators are approximations and do not guarantee service at a particular location.
Service quality may be affected by:
- distance from a cellular site;
- buildings, terrain, trees, or other physical obstructions;
- indoor use;
- weather;
- network congestion;
- maintenance or outages;
- device condition;
- software configuration;
- local radio interference;
- network technology changes; and
- circumstances outside TickTalk’s reasonable control.
Service may be slower, limited, delayed, interrupted, or unavailable in some locations or at some times.
TickTalk does not guarantee continuous, uninterrupted, error-free, or universal wireless coverage.
10. Network Management
To protect the network, users, and service quality, TickTalk and its underlying service providers may use reasonable network-management practices.
These practices may include:
- prioritizing emergency or time-sensitive traffic;
- managing congestion;
- reducing the speed of unusually high data usage;
- restricting unauthorized devices or applications;
- limiting activity that creates security or network risks;
- blocking fraudulent, malicious, unlawful, or abusive traffic; and
- temporarily restricting service when necessary to protect network integrity.
Network-management practices may vary based on network conditions, the selected plan, and the policies of underlying wireless providers.
Additional restrictions are described in the TickTalk Wireless Fair Use Policy.
11. Billing Cycle
TickTalk Wireless plans are prepaid unless otherwise expressly stated.
Subscription fees are charged in advance for each 30-day billing period.
Because the billing period is 30 days rather than a calendar month, your billing date may not fall on the same calendar date each month.
The applicable price, billing frequency, included services, and material plan terms will be displayed before you complete your purchase.
Taxes and government-imposed charges may be added where required by law.
12. Automatic Renewal
Unless you cancel before the next scheduled billing date, your TickTalk Wireless subscription will automatically renew at the end of each 30-day billing period.
By activating a subscription, you authorize TickTalk or its authorized payment processor to charge the applicable subscription fee and any required taxes to the payment method associated with your account at the beginning of each new billing period.
This authorization remains in effect until you cancel the subscription.
Before you complete your purchase, TickTalk will disclose:
- that the plan automatically renews;
- the length of the billing period;
- the amount and frequency of the recurring charges;
- how to cancel; and
- TickTalk’s contact information.
TickTalk will provide an acknowledgment of your subscription and renewal terms in a form that you can retain.
California law requires automatic-renewal terms to be clearly presented before purchase, affirmative consumer consent, a retainable acknowledgment, and an online cancellation method for subscriptions accepted online.
13. Payment Information
You must provide a valid payment method to purchase and maintain TickTalk Wireless service.
You authorize TickTalk and its payment processors to:
- verify the payment information provided;
- charge subscription fees, taxes, and authorized purchases;
- retry a failed payment;
- update payment credentials through supported card-network services; and
- process refunds or credits when approved.
You are responsible for ensuring that your payment and billing information remains current and accurate.
If payment cannot be successfully processed, TickTalk may:
- notify you;
- retry the payment;
- restrict or suspend service;
- prevent renewal;
- terminate the subscription; or
- require payment before restoring service.
Restoration of service after nonpayment may require reactivation, account verification, or payment of outstanding charges.
14. Price and Plan Changes
TickTalk may introduce new plans, discontinue plans, or change the price, included services, data allowances, features, or other terms of a plan.
Where required by applicable law, TickTalk will provide advance notice of a material plan change or fee increase and explain how to cancel before the change takes effect.
A change to the subscription price will not be applied retroactively to a billing period that has already been paid.
If you continue the subscription after a notified change takes effect, the updated terms and price will apply, subject to applicable law.
15. Cancellation
You may cancel TickTalk Wireless through the subscription-management section of your TickTalk parent account or through another cancellation method made available by TickTalk.
You are responsible for canceling before the next scheduled billing date if you do not want to be charged for another 30-day period.
Cancellation stops future automatic-renewal charges.
After cancellation, you may generally continue using the service through the end of the prepaid billing period for which payment has already been made. Service will end when that billing period expires unless the service is suspended or terminated earlier because of fraud, unlawful use, a security risk, or another material violation.
The following actions do not automatically cancel your TickTalk Wireless subscription:
- deleting the TickTalk app;
- resetting the watch;
- discontinuing use of the device;
- removing the SIM card;
- replacing or exchanging the device;
- sending the device for repair;
- returning the device for a refund;
- losing or damaging the device; or
- canceling a separate product order or warranty claim.
If you return, replace, repair, exchange, lose, or stop using a TickTalk device, you must separately cancel the wireless subscription if you do not want it to renew.
16. Refunds and Credits
TickTalk Wireless plans are prepaid and generally nonrefundable once a 30-day billing period has begun.
Except where required by applicable law or expressly approved by TickTalk, we do not provide prorated refunds, credits, or reimbursements for:
- unused or partially used service;
- failure to use the service;
- lack of coverage at a particular location;
- cancellation before the end of the current billing period;
- a child no longer using the device;
- loss, damage, repair, replacement, exchange, return, or deactivation of a device;
- failure to separately cancel the wireless plan after returning a device;
- temporary service interruptions;
- suspension resulting from nonpayment or a policy violation; or
- loss of access to a feature included with the plan.
Canceling the subscription prevents charges for future billing periods but does not ordinarily create a refund or credit for the remaining portion of the current prepaid period.
Nothing in this section limits refund rights that cannot lawfully be excluded.
17. Fair Use Policy
All TickTalk Wireless plans are subject to the TickTalk Wireless Fair Use Policy.
The Fair Use Policy is intended to protect TickTalk users, underlying networks, and service quality from unreasonable, unauthorized, fraudulent, abusive, or excessive use.
Without limiting the Fair Use Policy, you may not use TickTalk Wireless for:
- commercial resale;
- providing service to multiple users or unrelated devices;
- tethering or hotspot use;
- continuous streaming or activity that consumes unreasonable network capacity;
- automated calling or messaging;
- bulk or unsolicited communications;
- nuisance, harassing, threatening, or fraudulent calls;
- illegal file sharing;
- access to or distribution of unlawful content;
- security attacks or network interference;
- SIM use in an unauthorized device; or
- any activity inconsistent with normal personal smartwatch use.
If we reasonably determine that usage violates the Fair Use Policy, we may provide notice and take measures including:
- requesting additional information;
- restricting certain features;
- reducing data speed;
- blocking particular traffic;
- suspending service;
- requiring payment of additional charges where disclosed and permitted; or
- terminating service in cases of repeated, excessive, unlawful, or fraudulent use.
The underlying Gigs service terms similarly restrict SIM use to the intended wearable device, prohibit fraudulent use, and permit action against unreasonable network consumption.
18. Prohibited Uses
You may not use TickTalk Wireless to:
- violate any law or regulation;
- commit fraud or impersonate another person;
- threaten, harass, stalk, exploit, or harm another person;
- transmit spam or unsolicited bulk communications;
- make automated or artificial calls or messages;
- interfere with emergency communications;
- distribute malware, viruses, or harmful code;
- attack, scan, test, or compromise a network or system;
- bypass service, account, security, or usage restrictions;
- conceal or falsify device, account, caller, or network information;
- manipulate an IMEI, SIM, eSIM, phone number, or activation credential;
- access another person’s account without authorization;
- collect personal information without authorization;
- infringe intellectual-property or privacy rights;
- distribute unlawful, abusive, or exploitative content;
- use the service for commercial resale; or
- impose an unreasonable or disproportionately large burden on the service or network.
TickTalk may investigate suspected violations and cooperate with underlying carriers, payment providers, law enforcement, regulators, or other appropriate parties where permitted or required by law.
19. Phone Numbers
A phone number assigned to a TickTalk Wireless account may be subject to numbering rules, carrier requirements, and availability.
You do not own the phone number assigned to your account. You receive a limited right to use the number while the applicable service remains active.
A number may be changed, reassigned, suspended, or lost because of:
- cancellation;
- nonpayment;
- account inactivity;
- carrier or regulatory requirements;
- fraud or security concerns;
- technical changes;
- failure to complete a transfer request; or
- circumstances outside TickTalk’s reasonable control.
After service ends, the number may be returned to the numbering pool and assigned to another user.
You are responsible for updating any contacts or accounts that rely on the number.
20. Number Transfers
Number-transfer or porting availability is not guaranteed.
A request to transfer a number may require:
- accurate account information;
- identity verification;
- an active eligible account;
- transfer authorization;
- a transfer PIN or similar credential;
- resolution of account restrictions; and
- cooperation by the current or receiving carrier.
Transfers may be delayed or rejected because of inaccurate information, fraud-prevention measures, technical limitations, regulatory requirements, or carrier processes.
TickTalk is not responsible for delays caused by another carrier or by incorrect information supplied by the customer.
Canceling service before a number transfer is completed may result in loss of the number.
21. Roaming and International Use
Domestic roaming or international service is available only where expressly included in the applicable plan or purchased as an additional service.
International travel plans, where offered, may be subject to:
- supported-country lists;
- activation windows;
- expiration periods;
- data allowances;
- network availability;
- local carrier coverage;
- device compatibility;
- active U.S. service requirements; and
- separate pricing and terms.
International service may be data-only and may not include standard cellular voice calling, SMS, or emergency calling.
Availability and service quality outside the United States are not guaranteed.
You are responsible for reviewing the applicable travel-plan details before purchase and use.
22. Emergency Features and 911
Certain compatible TickTalk devices may support SOS features and the ability to place calls to 911.
Emergency features depend on factors including:
- an active device;
- network availability;
- signal strength;
- device power;
- valid service;
- accurate configuration;
- geographic coverage;
- software condition; and
- the ability of an emergency service provider to receive and process the call.
A TickTalk device is not a substitute for direct adult supervision or a dedicated emergency-response service.
Location information provided during an emergency may be unavailable, delayed, incomplete, or inaccurate.
Parents should teach children how and when to call 911 and should not rely solely on automated SOS, GPS, or remote-notification features during an emergency.
You may not test, misuse, or place false emergency calls.
23. Location Services
GPS and location features are intended to assist parents and guardians but do not guarantee a child’s exact or current location.
Location results may be affected by:
- GPS satellite visibility;
- indoor use;
- cellular and Wi-Fi availability;
- device power;
- network delays;
- building materials;
- environmental conditions;
- software settings; and
- whether the device is being worn or carried.
Location information may sometimes be estimated, delayed, unavailable, or inaccurate.
Parents should not rely exclusively on TickTalk location features for emergencies, medical needs, supervision, or situations involving immediate danger.
24. Service Changes and Discontinuation
TickTalk may modify, replace, suspend, limit, or discontinue all or part of TickTalk Wireless because of:
- network changes;
- carrier requirements;
- legal or regulatory obligations;
- security risks;
- technology changes;
- service-provider availability;
- device compatibility;
- licensing requirements;
- operational needs; or
- discontinuation of a product or service.
Where reasonably practicable and required by law, TickTalk will provide notice of material changes or service discontinuation.
TickTalk does not guarantee the continued availability of a particular carrier, network technology, phone number, plan, feature, application, device model, or third-party integration.
25. Suspension and Termination
TickTalk may restrict, suspend, or terminate service if:
- payment is not successfully completed;
- you violate these Terms or the Fair Use Policy;
- a SIM or eSIM is used in an unauthorized device;
- the account is associated with fraud, abuse, unlawful activity, or a security risk;
- the service creates an unreasonable burden on a network;
- information supplied for the account is materially inaccurate;
- suspension is requested or required by an underlying carrier, regulator, court, or governmental authority;
- continued service is technically or legally impracticable; or
- TickTalk discontinues the applicable service.
Where appropriate, TickTalk may provide notice and an opportunity to correct the issue before termination. Immediate action may be taken when necessary to address fraud, illegal conduct, security threats, emergency conditions, or network harm.
Your payment and other obligations relating to periods before termination remain enforceable after service ends.
26. Communications and Notices
By creating a TickTalk Wireless account, you agree that we may send service-related communications to the email address, telephone number, app account, or other contact method associated with your account.
Service-related communications may include:
- activation notices;
- billing confirmations;
- payment failures;
- renewal information;
- cancellation confirmations;
- security alerts;
- plan or price changes;
- network notices;
- legal notices;
- service interruptions; and
- account-support messages.
You are responsible for maintaining current contact information and reviewing service-related communications.
Marketing communications are subject to separate consent and opt-out rights where applicable.
27. Privacy
Our collection, use, disclosure, retention, and protection of personal information are described in the applicable TickTalk Privacy Policy.
Wireless-service providers, network operators, payment processors, cloud providers, and other service providers may process limited information as necessary to provide, bill, secure, support, and measure the service.
Use of TickTalk Radio is subject to the separate TickTalk Radio Privacy Policy.
28. Third-Party Services
TickTalk Wireless relies on third-party providers, including:
- wireless carriers and network operators;
- roaming providers;
- payment processors;
- SIM and eSIM technology providers;
- cloud and hosting providers;
- mapping and location providers;
- content providers; and
- security and customer-support providers.
TickTalk may change third-party providers without notice unless notice is required by law or the change materially affects your subscription.
Third-party services may be subject to separate terms, privacy notices, restrictions, and availability.
TickTalk is not responsible for third-party services that are outside our reasonable control, except to the extent required by applicable law.
29. Intellectual Property
TickTalk Wireless, TickTalk software, applications, interfaces, designs, graphics, text, logos, trademarks, service marks, and related technology are owned by TickTalk or its licensors and are protected by intellectual-property laws.
Subject to these Terms, TickTalk grants you a limited, personal, nonexclusive, nontransferable, revocable right to use TickTalk Wireless solely for its intended personal and noncommercial purpose.
You may not:
- copy, modify, distribute, sell, rent, sublicense, or create derivative works from TickTalk technology;
- reverse engineer, decompile, or disassemble TickTalk software;
- remove proprietary notices;
- use TickTalk branding without written authorization; or
- use TickTalk services or content for an unauthorized commercial purpose.
No ownership rights are transferred to you under these Terms.
30. Feedback
You may provide suggestions, comments, or feedback about TickTalk Wireless.
Unless otherwise agreed in writing, you grant TickTalk permission to use, evaluate, adapt, and implement feedback without compensation or obligation to you.
Do not submit information that you consider confidential or proprietary through a general feedback channel.
31. Disclaimer of Warranties
To the fullest extent permitted by applicable law, TickTalk Wireless is provided on an “as is” and “as available” basis.
TickTalk does not warrant that:
- service will always be available;
- coverage will exist in every location;
- calls, messages, data, GPS, SOS, or emergency features will always be transmitted or received;
- the service will be uninterrupted, secure, timely, or error-free;
- all defects will be corrected;
- every network, device, application, or third-party service will remain compatible; or
- service will meet every user’s individual requirements.
Nothing in these Terms excludes or limits warranties, consumer rights, or remedies that cannot lawfully be excluded or limited.
32. Limitation of Liability
To the fullest extent permitted by applicable law, TickTalk and its affiliates, officers, employees, agents, licensors, underlying carriers, network operators, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to TickTalk Wireless.
This includes damages relating to:
- loss of use;
- loss of data;
- loss of a phone number;
- service interruption;
- missed or delayed calls or messages;
- unavailable or inaccurate location information;
- unavailable emergency features;
- unauthorized account access;
- third-party services; or
- inability to access a particular plan, network, feature, or content service.
To the fullest extent permitted by applicable law, TickTalk’s total aggregate liability for claims arising specifically from TickTalk Wireless will not exceed the greater of:
- the amount you paid for TickTalk Wireless during the six months immediately preceding the event giving rise to the claim; or
- fifty U.S. dollars.
Some jurisdictions do not allow certain liability limitations. In those jurisdictions, these limitations apply only to the extent permitted by law.
33. Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless TickTalk and its affiliates, officers, employees, agents, licensors, network providers, and service providers from claims, liabilities, losses, damages, and reasonable costs arising from:
- your material violation of these Terms;
- unlawful, fraudulent, or abusive use of the service;
- unauthorized use of a SIM, eSIM, device, or account;
- your violation of another person’s rights;
- information or instructions you provide that are inaccurate or unauthorized; or
- your willful misconduct.
This section does not require indemnification for claims caused by TickTalk’s own unlawful conduct or to the extent prohibited by applicable law.
34. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.
Any dispute not otherwise resolved through an applicable written dispute-resolution agreement may be brought in a court of competent jurisdiction.
Nothing in these Terms limits nonwaivable rights or remedies available under federal, state, or local law.
35. California Consumer Notice

California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs regarding complaints that have not been resolved directly with TickTalk.
36. Changes to These Terms
TickTalk may update these Terms to reflect changes in:
- wireless plans;
- billing practices;
- features;
- network providers;
- technology;
- legal requirements;
- security practices; or
- business operations.
When we update these Terms, we will revise the “Last Updated” date.
Where required by law, we will provide advance notice of material changes and obtain any additional consent required before the changes apply.
Your continued use of TickTalk Wireless after updated Terms take effect constitutes acceptance of the updated Terms, except where applicable law requires express consent.
37. Assignment
You may not assign or transfer your TickTalk Wireless account, subscription, phone number, SIM, eSIM, rights, or obligations without TickTalk’s written authorization.
TickTalk may assign these Terms or related rights and obligations as part of a merger, acquisition, financing, corporate reorganization, sale of assets, or transfer of the applicable business, subject to applicable law.
38. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law.
The remaining provisions will continue in effect.
39. No Waiver
TickTalk’s failure to enforce a provision of these Terms does not waive the right to enforce that provision or another provision later.
A waiver is effective only if it is in writing and authorized by TickTalk.
40. Entire Agreement
These Terms, together with the TickTalk Wireless Fair Use Policy, Privacy Policy, applicable plan details, checkout disclosures, and any additional service-specific terms, form the entire agreement between you and TickTalk regarding TickTalk Wireless.
If a service-specific term directly conflicts with these Terms, the service-specific term will control only for that particular service and only to the extent of the conflict.
