TickTalk Radio Privacy Policy

1. Scope

This Privacy Policy explains how TickTalk Tech LLC (“TickTalk,” “we,” “us,” or “our”) collects, uses, discloses, retains, and protects information in connection with TickTalk Radio.

TickTalk Radio is a parent-managed service designed for children. A parent or legal guardian purchases and manages the subscription through a TickTalk parent account and controls the child’s age group, station access, and other available settings.

This Privacy Policy applies specifically to TickTalk Radio. Other TickTalk products, applications, websites, wireless services, and features may also be subject to the general TickTalk Privacy Policy or other applicable privacy notices.

2. Information We Collect

A. Parent and Account-Holder Information

A parent or legal guardian must purchase and manage the TickTalk Radio subscription. In connection with the parent-managed account and subscription, we may collect or use:

  • The parent or account holder’s name;
  • Email address;
  • Billing address;
  • Account identifiers;
  • Subscription status;
  • Billing status and transaction information;
  • Payment status;
  • Customer support communications;
  • Privacy or content-related requests; and
  • Other information reasonably necessary to administer the account and subscription.

Payment information, such as a payment card number, may be collected and processed by TickTalk’s authorized payment service providers.

TickTalk may receive limited payment-related information, such as the payment method type, last four digits of the payment card, payment status, transaction date, and transaction identifier. TickTalk generally does not directly store complete payment card numbers.

B. Child Profile and Parent-Selected Settings

TickTalk Radio may be associated with an existing child or device profile created and managed by the parent or legal guardian. Depending on the information contained in that profile and the settings selected by the parent, we may process:

  • The child’s name or nickname;
  • The child’s selected age group;
  • Internal child-profile identifiers;
  • Device identifiers;
  • Enabled and disabled station settings;
  • Parental-control settings; and
  • Subscription entitlement information.

C. TickTalk Radio Usage Information

Depending on how TickTalk Radio is used, we may collect or process:

  • Station identifiers;
  • Song or content identifiers;
  • Playback start and completion events;
  • Playback counts;
  • Dates and times of playback;
  • Favorite station selections;
  • Likes or other content-feedback selections;
  • Station or content-sharing activity;
  • Internal sender and recipient identifiers used for sharing;
  • Service errors and diagnostic information;
  • App version;
  • Device model;
  • Operating-system version;
  • Network status;
  • IP address, session identifiers, or similar technical identifiers where reasonably necessary to provide, secure, or measure the service; and
  • Security and fraud-prevention information.

TickTalk Radio provides a station-based listening experience and does not allow users to select and play individual songs on demand or download songs for offline use.

3. Information Children Are Not Asked to Submit Directly

TickTalk Radio is accessed through a parent-managed TickTalk account. Children are not asked to independently provide the following information through the TickTalk Radio service:

  • A personal email address;
  • Payment card information;
  • A billing address;
  • A public profile;
  • A written biography; or
  • A public social-media account.

TickTalk Radio does not allow children to publicly upload or post their own music, photographs, videos, written comments, or other user-generated content through the radio service.

A child’s existing TickTalk profile may include a name or nickname entered by the parent or legal guardian. That information is managed through the parent-controlled TickTalk account rather than submitted independently by the child through TickTalk Radio.

4. How We Use Information

We may use information to:

  • Provide and operate TickTalk Radio;
  • Authenticate the parent-managed account;
  • Confirm that a subscription is active;
  • Make age-group-appropriate stations available;
  • Save parental station controls;
  • Save favorite stations;
  • Process likes and other content feedback;
  • Support station or content recommendations shared between approved TickTalk contacts;
  • Deliver and rotate station content;
  • Measure station and content usage;
  • Identify popular stations and songs;
  • Maintain licensing and royalty-related records;
  • Process and manage subscription payments;
  • Diagnose technical problems;
  • Maintain and improve service reliability;
  • Protect the security and integrity of TickTalk Radio;
  • Detect and prevent fraud, misuse, or unauthorized access;
  • Respond to customer support, content, and privacy requests;
  • Improve station selection, content curation, and service performance;
  • Enforce our Terms of Use; and
  • Comply with applicable legal, accounting, licensing, and regulatory obligations.

5. Children’s Privacy and COPPA

TickTalk Radio is designed for children and is managed by a parent or legal guardian.

Where the Children’s Online Privacy Protection Act and its implementing regulations apply, TickTalk will take steps designed to comply with applicable COPPA requirements, including, as required:

  • Providing parents with notice of our information practices;
  • Obtaining verifiable parental consent before collecting, using, or disclosing personal information online from a child;
  • Collecting only information reasonably necessary to provide and support TickTalk Radio;
  • Giving parents the ability to review personal information collected from their child;
  • Allowing parents to request deletion of eligible personal information;
  • Allowing parents to refuse further collection or use of eligible personal information;
  • Maintaining reasonable procedures designed to protect the confidentiality, security, and integrity of children’s personal information; and
  • Retaining children’s personal information only for as long as reasonably necessary to fulfill the purpose for which it was collected.

We do not condition a child’s participation in TickTalk Radio on the child providing more personal information than is reasonably necessary to use the service.

We do not use children’s TickTalk Radio activity for third-party targeted advertising, cross-context behavioral advertising, or the creation of advertising profiles.

6. Favorites and Sharing

When a child marks a station as a favorite, we may store the station identifier and associate it with the child’s TickTalk profile or device so that the favorite can be displayed again.

When a child shares a station or content recommendation with an approved TickTalk friend or contact, we may process:

  • The sender’s internal account, profile, or device identifier;
  • The recipient’s internal account, profile, or contact identifier;
  • The shared station or content identifier;
  • The date and time of sharing; and
  • Delivery, error, or security status.

Sharing a station or content recommendation does not transmit, copy, or transfer the underlying music file.

Sharing is limited to TickTalk-supported features and approved TickTalk contacts. Sharing information is not posted publicly and is used only to provide, secure, maintain, and support the sharing feature.

7. How We Disclose Information

A. Service Providers

We use service providers to support functions such as:

  • Music licensing and content delivery;
  • Application and cloud hosting;
  • Subscription and payment processing;
  • Usage measurement and reporting;
  • Security and fraud prevention;
  • Technical support; and
  • Customer communications.

Our music content and technology providers do not need a child’s name, email address, mailing address, billing address, or payment information to deliver music content through TickTalk Radio.

Where reasonably necessary to provide or measure the service, music content and technology providers may receive or process limited technical and usage information, such as:

  • Station or song identifiers;
  • Playback counts;
  • Playback dates and times;
  • Session, device-related, or similar technical identifiers where technically necessary;
  • Likes or other content-feedback signals; and
  • Error or content-delivery information.

We require service providers to process information only for authorized and contracted purposes, maintain appropriate privacy and security safeguards, and not use children’s personal information for targeted advertising.

B. Legal, Safety, and Security Purposes

We may disclose information when we reasonably believe disclosure is necessary to:

  • Comply with applicable law, regulation, legal process, or governmental request;
  • Protect the rights, property, or safety of TickTalk, our users, children, parents, or others;
  • Investigate fraud, misuse, security incidents, or violations of our agreements; or
  • Establish, exercise, or defend legal claims.

C. Business Transactions

Information may be disclosed as part of a proposed or completed merger, acquisition, financing, reorganization, sale of assets, or similar business transaction.

Any recipient of children’s personal information will be required to handle that information in accordance with applicable law and the commitments described in this Privacy Policy.

8. No Sale or Targeted Advertising

We do not sell children’s personal information.

We do not share children’s personal information for cross-context behavioral advertising or targeted advertising.

TickTalk Radio does not display third-party behavioral advertisements to children based on their listening activity.

9. Aggregated and De-Identified Information

We may create aggregated or de-identified information regarding:

  • Station popularity;
  • Playback volume;
  • General listening times;
  • Favorite selections;
  • Likes and content feedback;
  • Content performance;
  • Technical performance; and
  • Service reliability.

We may use aggregated or de-identified information to improve TickTalk Radio, support content curation, prepare licensing and royalty reports, understand general service usage, and maintain service performance.

We will take reasonable measures designed to prevent information treated as de-identified from being used to identify an individual child.

10. Data Retention

We retain personal information only for as long as reasonably necessary to fulfill the specific purposes for which it was collected, including to:

  • Provide TickTalk Radio;
  • Maintain parental settings and favorite stations;
  • Support sharing functions;
  • Maintain subscription, billing, and transaction records;
  • Meet licensing, royalty-reporting, accounting, tax, and legal obligations;
  • Resolve disputes;
  • Detect and prevent fraud;
  • Enforce our agreements; and
  • Protect the security and integrity of the service.

Retention periods may vary depending on the type of information, the purpose for which it was collected, and applicable legal requirements.

When personal information is no longer reasonably necessary for an authorized purpose, we will delete it or de-identify it, subject to applicable legal, accounting, security, and record-retention requirements.

We do not retain children’s personal information indefinitely.

11. Data Security

We maintain reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, use, loss, alteration, or disclosure.

These safeguards may include access controls, authentication measures, encryption where appropriate, system monitoring, employee or contractor access restrictions, and procedures for responding to security incidents.

No internet-connected service, data transmission, or storage system can be guaranteed to be completely secure.

12. Parental Rights and Choices

Subject to applicable law, a parent or legal guardian may request to:

  • Review personal information collected from their child through TickTalk Radio;
  • Correct inaccurate personal information;
  • Request deletion of eligible personal information;
  • Withdraw consent to further collection, use, or disclosure of eligible personal information;
  • Disable individual stations;
  • Change the child’s selected age group;
  • Manage favorite-station settings;
  • Disable applicable sharing features; or
  • Refuse further collection or use of eligible personal information.

We may need to verify the requesting adult’s identity, account ownership, and parental or legal authority before completing a request.

Certain information may be retained when reasonably necessary to complete transactions, comply with applicable law, maintain licensing or accounting records, prevent fraud, protect security, or establish or defend legal claims.

Withdrawing consent or requesting deletion may limit or prevent the continued use of some or all TickTalk Radio features.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in TickTalk Radio, our information practices, legal requirements, or service providers.

When we make changes, we will update the “Last Updated” date at the top of this page.

Where required by applicable law, we will provide additional notice to the parent or legal guardian and obtain updated parental consent before making material changes to the collection, use, or disclosure of a child’s personal information.
